Terms of Service

These terms are the agreement between you and AJTV Limited (Hong Kong), trading as Fit Nomads ("we", "us"). By purchasing or using our services you agree to them.

They cover both sides of what we do: online coaching you buy through this website, and the Fit Nomads iOS app you subscribe to through the App Store. Most of it applies to both. Where the two are billed differently, section 3 covers the website and section 4 covers the app.

1. What we provide

We provide online health and fitness education and coaching. That comes in two forms:

• Online coaching bought through this website. Subscription-based training and nutrition programs, and one-to-one online coaching, delivered remotely.
• The Fit Nomads iOS app. A subscription app for tracking food, training, habits and travel, bought through the Apple App Store.

Everything is delivered remotely. We hold no inventory and have no physical premises.

We provide general fitness coaching. We are not doctors, dietitians or medical practitioners, and nothing we provide is medical advice, diagnosis or treatment. Section 5 says more about that.

2. Eligibility and health

• You must be at least 18 years old. That applies to everything we run: buying coaching on this website, creating a Fit Nomads account, and downloading, subscribing to or using the Fit Nomads app.
• You must be legally able to enter a contract.
• You confirm you are in general good health and able to take part in physical exercise.
• You agree to consult your doctor before starting, particularly if you are pregnant, recovering from injury or illness, or have any medical condition.

The service is built for adults and is not directed at children. We do not knowingly hold data from anyone under 18. If we find out an account belongs to someone under 18 we will close it and delete the data, and you can tell us at support@thefitnomadsofficial.com if you believe that has happened.

You take part at your own risk, and you are responsible for stopping and seeking medical advice if something feels wrong.

3. Prices, payment and billing on the website

This section covers what you buy from us here. App Store subscriptions are billed by Apple and are covered in section 4.

• Prices are stated and charged in either Australian dollars (AUD) or US dollars (USD), depending on the program. We historically billed in AUD and now bill new programs in USD, and some existing clients remain on AUD billing. The currency that applies to you is shown at checkout and on every receipt. Your bank may apply its own conversion or foreign transaction fees.
• Website and coaching payments are processed by Airwallex. We never see or store your full card number.
• Coaching is sold as a recurring subscription. Your card is charged automatically each billing period until you cancel. Pricing is set per week and varies by program and length, from AUD 95 per week up to USD 99 per week.
• Auto-renewal is disclosed before you pay. We show you the charge amount, the currency (AUD or USD), the billing frequency and the date of the next charge at checkout, and you must give express consent by ticking a box. Consent is never implied by purchase alone.
• Your subscription continues until you cancel it. Cancel a website subscription by emailing support@thefitnomadsofficial.com and we will stop the next charge. Deleting your Fit Nomads account does not cancel your billing.
• We send a confirmation email after purchase restating these terms.
• If a payment fails we may retry it and will contact you. Access may be paused until the account is up to date.
• We may change our prices, but never for a plan you have already purchased.

4. The app, and App Store subscriptions

The Fit Nomads iOS app is sold as an auto-renewable subscription through the Apple App Store. If you subscribe inside the app, Apple takes the money and these rules apply instead of section 3.

• Apple bills you, not us. Payment is charged to your Apple Account when you confirm the purchase. We never see or hold your card details.
• The price and the billing period are the ones shown in the App Store at the moment you buy, in your local App Store currency. That screen is what you are agreeing to, and it is the version that counts if it differs from anything written elsewhere.
• It renews automatically. Your subscription renews for the same period at the same price unless you turn off auto-renew at least 24 hours before the current period ends. Apple charges the renewal within the 24 hours before that.
• You manage and cancel it in your Apple Account. On your iPhone or iPad, open Settings → Apple Account → Subscriptions and choose Fit Nomads. Cancelling stops the next renewal, and you keep access until the period you have already paid for runs out.
• Refunds for App Store purchases are handled by Apple, under Apple's own policies, at reportaproblem.apple.com. We cannot refund money Apple collected, though email us and we will help you put the request together.
• Deleting your account or the app does not cancel your subscription. Billing carries on until you cancel it in your Apple Account. Cancel first, then delete, and if you have already deleted and are still being charged, email us and we will help you sort it out.
• App Store purchases are also subject to Apple's Media Services Terms and Conditions and to whatever Apple shows you before you buy.

The licence for the app itself. The app is licensed to you rather than sold, under Apple's standard Licensed Application End User Licence Agreement ("the Apple EULA"), which is the app's standard EULA. These terms sit on top of it and cover the Fit Nomads service the app connects to: your account, your data, your subscription and the coaching side of things. Where the two disagree about the licence to use the software, the Apple EULA wins. Apple is not responsible for the Fit Nomads service and does not provide support for it, so bring anything you need to support@thefitnomadsofficial.com.

5. Guidance, estimates and medical advice

Everything the app and your coach give you is general fitness and nutrition education. Calorie and macro targets, energy-expenditure figures, the numbers read off a photo of your dinner, body-composition values and the weekly roundup are all estimates, worked out from published equations and from what you logged. They are not measurements of your body, and they can be wrong. The app says the same thing next to the numbers themselves.

None of it is medical advice, diagnosis or treatment, and we are not doctors, dietitians or medical practitioners. Talk to your doctor or a dietitian before changing how you eat or train, especially if you are pregnant, managing a health condition, recovering from injury, or have any history of disordered eating. Never delay or ignore advice from a medical professional because of something Fit Nomads told you, and if something feels wrong, stop and go and get it checked.

6. Delivery

Programs are delivered digitally through the Fit Nomads app, with access sent to your email within 24 hours of purchase. See the Delivery Policy.

7. Cancellation and refunds

You can cancel at any time, whichever way you bought. A website subscription is cancelled through us by email, and it is billed from the start with no free trial, renewing until you cancel. An App Store subscription is cancelled in your Apple Account, and refund requests for those purchases go to Apple under its policies — see section 4. When refunds otherwise apply is set out in our Refund Policy, and cancellation in our Cancellation Policy, which both form part of these terms.

8. Geographic and export restrictions

We sell worldwide, with the following exceptions. We do not provide services to, and you may not purchase if you are located in or ordinarily resident in, any country or territory subject to comprehensive economic sanctions, or if you appear on any applicable restricted or denied party list. You are responsible for complying with the laws of your own country. We may refuse or cancel an order where we believe supplying it would breach sanctions or applicable law, and we will refund any amount paid in that case.

9. Acceptable use and your account

• Your program is licensed to you personally. Do not share your login, or resell, distribute or publish our materials.
• Keep your account details secure. One account per person.
• Use the app the way it is meant to be used. Do not copy, reverse-engineer or tamper with it, do not try to get around the subscription check, and do not use it in any way that breaks Apple's App Store rules or the law where you are.
• Be respectful in the member community and on coaching calls. We may remove access for abusive behaviour, without refund.

10. Intellectual property

All programs, videos, recipes, written materials and branding remain our property. You get a personal, non-transferable licence to use them for your own training while you have access.

11. Disclaimers and liability

Results vary. We do not guarantee any specific outcome, weight, body composition or performance result. What you achieve depends on factors outside our control, including your consistency, genetics, health and circumstances.

We provide our services with reasonable care and skill, but to the fullest extent permitted by law we exclude liability for indirect or consequential loss. Our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing here excludes liability that cannot legally be excluded, including for death or personal injury caused by negligence, or your rights under mandatory consumer law.

12. Governing law

These terms are governed by the laws of Hong Kong, where AJTV Limited is incorporated, and the Hong Kong courts have non-exclusive jurisdiction. If you are a consumer you keep the benefit of any mandatory protections of your country of residence.

13. Changes

We may update these terms. The date at the top shows the current version, and changes are not applied retrospectively to a purchase you have already made.
